CENTRAL BUREAU OF INVESTIGATION: The Central Bureau of Investigation(CBI) is the premier investigating agency of India. Operating under the jurisdiction of the Ministry of Personnel, Public Grievances and Pensions, the CBI is headed by the Director who is a Joint Secretary level officer in the Union Government.
In its present form, the CBI was established in 1963 with the enactment of the Delhi Special Police Establishment (DSPE) Act, 1946 for a limited period till Parliament enacted necessary legislation to create an independent body to investigate corruption cases.
Section: The organisation was later re-constituted in 1963 and renamed as the CBI with wider powers. With this expansion of powers, there have also been a corresponding expansion in its responsibilities and functions, which have been gradually added through various legislations and government Resolutions (GRs).It is a Non-Constitutional Body
Section: The CBI covers all inter-state criminal activities in India and can take over any investigation at the request of State Governments.
Section: The Central Bureau of Investigation has a special unit called Anti Corruption Branch(ACB). This wing focuses on graft cases related to defense deals, irregularities in public procurement process, acquisition, real estate and transportation. The ACB also handles other cases such as disproportionate assets of government.
STRUCTURE OF CBI
CBI does not have a fixed jurisdiction – its jurisdiction is determined by the Government of India, and similarly its headquarters is located in the national capital New Delhi.
POWERS OF CBI
CBI has the following powers:
(i) The power to register FIR or for initiating suo moto action.
(ii) The power to conduct preliminary enquiry into a matter on receipt of credible information or upon complaint from victim, his/her family members, relatives or friends.
(iii) The power to arrest accused person and carry out investigation in accordance with the provisions of Criminal Procedure Code, 1973.
FUNCTIONS :-
Investigation of case on directions given by Central Government u/s 3 of DSPE Act 1946; and Investigation of cases which are referred by Supreme Court / High Court under article 32 & 226 respectively and all other cases which are registered on orders passed by the Courts etc.
